Community property: report 50% of spouse income?
I don't know how come one person can file his/her tax return in two different states in the same time. This's interesting. My opinion is Ada had a half of Mike's income, she should file it in CA since that income is a community property and CA adopts it, but not NJ, but that means she also needs to file her NJ's income in CA too. Sure, Ada couldn't claim her half income from the community property since NJ does not adopt it. Generally speaking, Ada needs to choose that she wanna file her whole income in CA or NJ. I don't think she can't file both of them in 2 states, since Mark couldn't file his jointly tax also in NJ. Another thing, it was confusing here, why Mike couldn't file jointly tax in NJ? I think he could, but he just couldn't claim his community property. So, that's why he is better claiming that in CA with Ada. Anyway, you really need to talk with a CPA.
